The union says it's acting on legal advice and it's now up to Toronto police to investigate.
Last month, Unifor accused former president Jerry Dias of accepting $50,000 from a supplier of COVID-19 rapid test kits he promoted to union member employers after an employee filed a complaint to the union.
He was charged with violating the union's code of ethics and democratic processes.
A hearing will be held before the national executive board.
