The restaurants have been given the green light to stay open past 11 o'clock, at least temporarily.
A judge issued a preliminary injunction over the weekend in a lawsuit filed by the group against the states curfew.
Originally the governor had ordered restaurants to close at 10 pm then changed it to 11 pm.
The court order notes there is a lack of scientific evidence showing people at restaurants and bars are at a higher risk of contracting or spreading COVID-19 at any time, let alone after 10 p.m. or 11 p.m.
